Fields of Practice

My practice is more or less exclusively dispute based. I do not generally get involved with drafting documents that are not involved with some form of dispute. If there is a dispute that has already arisen or is anticipated, however, I am willing and able to help with a very wide range of subjects.

The dispute may give rise to litigation, which is to say determination by the court but with increasing frequency the dispute is resolved by arbitration or mediation. Sometimes an attempted mediation takes place alongside litigation or during a period during which the litigation is stayed to facilitate the mediation.

SUMMARY

My fields of practice can be summarised very briefly as: property, business, commercial or building and construction disputes.

In greater detail the fields of practice are as given below, but even this list is not exhaustive. If you are in any doubt please ask me or one of my clerks who will provide you with further information related to your dispute. This will be done informally, quickly and entirely without obligation. Inquiries about fee and costs levels will be dealt with in the same way.

Banking including loan arrangements, bankers’ securities and guarantees
Building and Construction Disputes most cases within the jurisdiction of the Technology and Construction Court
Contract including any sort of business or commercial contract, whether the dispute concerns the existence of the contract itself, the performance of it or remedies for breach
Companies including shareholder disputes, petitions to wind up on the “just and equitable ground”, unfair prejudice petitions, company charges, directors’ duties and disqualification proceedings
Fraud all civil aspects, but especially claims involving constructive trust, abuse of property, duty or position
Injunctions and Equitable Relief pre-trial or at trial, tracing claims, specific performance, search orders and freezing orders
Insurance construction, claims under or avoidance of insurance contracts
Insolvency whether of individuals (bankruptcy) or of limited companies, claims in winding-up, misfeasance, recovery of assets, setting aside transactions, security and priority disputes, receivership and administrations
Intellectual Property most aspects, including copy right, passing off, trade secrets and trade marks
Landlord and Tenant whether commercial or residential
Mortgages all aspects
Partnership disputes between partners or with third parties; winding up of partnerships
Pensions most contentious aspects, including claims against employer companies in respect of employee schemes or against the trustees
Professional Negligence particularly of lawyers, accountants, financial advisers or connected with building and construction
Real Property including conveyancing, sale of land, restrictive covenants, easements and similar rights, boundary disputes
Sale of Goods all aspects, domestic and foreign
Torts in the property and commercial field, including negligence, nuisance, trespass and strict liability
Trusts Wills and Gifts interpretation, enforcement of obligations, breach of trust, disputes about validity (including testamentary or other capacity), undue influence
